As of the Effective Date, we do not use Google Analytics, Meta Pixel, or third-party advertising/retargeting trackers. If this changes, we will update this Policy and the Cookie Notice.

We do not knowingly collect “sensitive personal information” as defined under applicable U.S. state privacy laws (such as government identifiers, precise geolocation, biometric data, or health information). Please do not submit any such information to us.

3. How We Use Your Information

We use personal information for the following purposes:

  • Order Processing and Fulfillment: To accept, process, fulfill, ship, and confirm your orders.
  • Customer Support: To respond to inquiries, provide order status, and resolve issues.

  • Website Operation and Improvement: To operate, maintain, secure, and improve the Website and our services.
  • Legal Obligations: To comply with subpoenas, court orders, regulatory requests, tax and recordkeeping obligations, and other legal requirements.

We do not engage in profiling, automated decision-making that produces legal or similarly significant effects, or the sale of personal information.

4. Legal Bases for Processing

Where required by applicable law (such as the EU/UK GDPR for visitors from those regions), we process your personal information on the following legal bases:

  • Performance of a Contract: To process and deliver your order and provide customer support.
  • Legitimate Interests: To operate and secure the Website, prevent fraud, and improve our services, balanced against your rights and interests.
  • Consent: Where you have provided consent, such as for optional marketing emails.
  • Legal Obligation: Where processing is necessary to comply with applicable law.

5. How We Disclose Information

We do not sell your personal information, and we do not “share” your personal information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”).

We disclose personal information only to the following categories of recipients, and only as needed for the purposes listed in Section 3:

  • Payment Processors who process your payment, verify card authorization, and prevent payment fraud.
  • Shipping Carriers (such as USPS, UPS, FedEx, or other carriers we use) to deliver your order.
  • Technology Service Providers who host the Website, provide order-management or e-commerce platform services, send transactional email, and provide IT and security support, in each case under written agreements that limit their use of personal information to providing services to us.
  • Professional Advisors such as auditors, accountants, and attorneys, where reasonably necessary.
  • Legal and Regulatory Authorities when we believe in good faith that disclosure is necessary to comply with a legal obligation, respond to lawful process, enforce our Terms of Use, protect the rights, property, or safety of Primal Peptides, our customers, or others, or investigate suspected fraud or wrongdoing.
  • Successors in Interest: In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, in which case personal information may be transferred to the successor or acquirer subject to this Policy or successor terms.

We do not authorize service providers to use your personal information for their own marketing or any purpose other than providing services to us.

6. Cookies and Tracking Technologies

We use a limited set of strictly necessary cookies and similar technologies to operate the Website, maintain your shopping session, and remember your age-verification acknowledgment. We do not currently use Google Analytics, Meta Pixel, advertising pixels, retargeting trackers, or third-party behavioral-advertising technologies. For details on the specific technologies in use, their purposes, and how to manage your browser-level preferences, please see our Cookie Notice. We will update that notice and this Policy if our practices change.

Do Not Track: Because there is no industry standard for responding to “Do Not Track” signals, the Website does not currently respond to them. We instead respect the choices you make through this Policy and your browser settings.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to:

  • Provide our products and services and maintain your account;
  • Comply with our legal, tax, accounting, and recordkeeping obligations (including order and transaction records, which we generally retain for at least seven (7) years);
  • Resolve disputes, enforce our agreements, and protect against fraud or abuse;
  • Maintain backups and operational records for a reasonable, limited period.

When personal information is no longer needed, we will securely delete, de-identify, or anonymize it. If deletion is not technically feasible (for example, in archival backups), we will isolate the data and protect it from further processing until deletion is possible.

8. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, and destruction. These measures include encryption in transit (TLS) for the Website and checkout, restricted internal access on a need-to-know basis, vendor due-diligence for third-party processors, and routine review of our security practices. Our information-security program is designed to be consistent with the requirements of the New York Stop Hacks and Improve Electronic Data Security Act (the “SHIELD Act”).

No method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any account credentials and for promptly notifying us of any unauthorized use.

In the event of a data security breach affecting personal information, we will provide notice to affected individuals and to applicable regulatory authorities as required by, and within the timeframes prescribed by, applicable law.

9. Your Privacy Rights

Depending on where you reside and subject to applicable law, you may have some or all of the following rights with respect to your personal information:

  • Right to Know / Access: Request confirmation of whether we process your personal information and a copy of that information.
  • Right to Correct: Request correction of inaccurate or incomplete information.
  • Right to Delete: Request deletion of your personal information, subject to applicable legal exceptions (such as records we must retain for tax, recordkeeping, or fraud-prevention purposes).
  • Right to Portability: Request a copy of certain information you provided to us in a portable, readily usable format.
  • Right to Opt Out: Opt out of marketing communications at any time and, where applicable, opt out of the “sale” or “sharing” of personal information (we do not sell or share your personal information for cross-context behavioral advertising).
  • Right to Limit Use of Sensitive Personal Information: Where applicable; we do not knowingly collect sensitive personal information.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.
  • Right to Withdraw Consent: Where processing is based on consent, withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal.
  • Right to Lodge a Complaint: EU/UK residents may lodge a complaint with their local data-protection authority. California residents may contact the California Privacy Protection Agency.

To exercise any of these rights, email us at info@primalpeptides.org with the subject line “Privacy Request.” We will respond within the timeframes required by applicable law (generally within forty-five (45) days under the CCPA/CPRA, with one extension where permitted, and within one (1) month under the GDPR/UK GDPR). We may need to verify your identity before fulfilling your request and may decline a request to the extent permitted by law.

Authorized Agents (California): California residents may designate an authorized agent to submit a request on their behalf. We will require written proof of authorization and may require the consumer to verify their identity directly with us.

“Shine the Light” (California Civil Code § 1798.83): California residents may request information about our disclosure of personal information to third parties for their direct-marketing purposes. We do not disclose personal information to third parties for their own direct-marketing purposes.

The Website is operated from the United States and is intended for users located in the United States. If you access the Website from outside the United States, you understand that your personal information will be transferred to, stored in, and processed in the United States, where data-protection laws may differ from those in your jurisdiction. By using the Website or submitting information, you consent to such transfer and processing. Where required by law (for example, transfers from the EEA or UK), we rely on appropriate transfer mechanisms such as the European Commission’s Standard Contractual Clauses.

11. Children’s Privacy

The Website is not directed to and not intended for use by individuals under the age of twenty-one (21), and we do not knowingly collect personal information from anyone under 21. If you believe we have inadvertently collected personal information from a person under 21, please contact us at info@primalpeptides.org and we will take appropriate steps to delete that information.

The Website may contain links to third-party websites, services, or resources that we do not own or control. This Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party service you use.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or applicable law. When we do, we will revise the “Last Updated” date at the top of this Policy and, where the changes are material, provide additional notice (such as a homepage banner or email to account holders, where appropriate). Your continued use of the Website after the updated Policy becomes effective constitutes acceptance of the updated Policy.
